Woman sues Microsoft for Windows 10 upgrade and wins

Not long after Windows 10 became available for downloads last summer, Teri Goldstein, of Sausalito, California, noticed that the computer she used for her travel agency business was running slowly, to the point she couldn't use it at all.  She said it would crash or become unstable due to the update to Windows 10.

“I had never heard of Windows 10,” Goldstein said. “Nobody ever asked me if I wanted to update.”

Although she contacted Microsoft for support, they were unable to resolve the issues with her computer, so Ms. Goldstein took Microsoft to court.  She won her case, and now, Microsoft has dropped their appeal.  Microsoft admits no wrongdoing, but say they merely stopped the appeal process to save money on litigation.  Ms. Goldstein has been awarded $10,000, an estimate that she gave for lost work and a new computer system.

This is just the latest black eye for Microsoft's upgrade policy for Windows 10.  They have been castigated repeatedly over this last year for making Windows 10 difficult to avoid.  Many people have resorted to using third party programs to avoid the upgrade or the notices for the upgrade.  I personally have used a program called GWX Control Panel for this purpose on two Windows 7 machines that I don't want to upgrade.
