Eminem, Apple settle out of court

After five days inside the court room, Eight Mile Style and Apple have settled their legal dispute over several million dollars out of court.

"The case was settled to the satisfaction of all parties," according to Richard Busch, Eight Mile attorney.

Eight Mile and Martin Affiliated, another plaintiff in the case, wanted millions of dollars in the case -- the exact details of the settlement remain confidential.

Eminem_desktop_wallpaper-670x502Eminem, whose real name is Marshall Mathers, did not testify during the legal proceedings, and wasn't on the witness list.

Specifically, Apple stood accused of making more than $2.5 million from 93 Eminem songs offered through iTunes.  According to the lawsuit, Aftermath collected $4 million in revenue from iTunes sales of Eminem tracks.

Eight Mile wants an independent contract with Apple, allowing the record label to better track songs sold through iTunes.  Ultimately, it all comes down to the bottom dollar, which Eight Mile felt it wasn't receiving enough of from Apple -- exact evidence showing who was in the right wasn't released.

"Eight Mile and Martin (Affiliated) have not provided that permission," the legal briefing presented before the court battle began last week.  "Therefore, Apple's reproduction and distribution of the digital transmissions via iTunes constitutes a continuing, and willful, infringement of Eight Mile's and Martin's copyright interests."

Apple has had several issues with musicians and record labels, though most companies are pleased with the agreement they have with Apple.  This issue may put increased pressure on Apple to carefully write contract agreements to ensure digital copies are covered in music revenue agreements.
